‘We/our/us’ means Adavale Arts & Crafts whose registered office is Adavale, Heanish, Isle of Tiree, PA77 6UL.
‘customer’ means the person, organisation or company whose order is accepted by us.
‘order’ means the order for the purchase and sale of goods placed by the customer with us.
‘goods/items’ means the products specified in the order.
‘price’ means the price for the goods, excluding any carriage, packaging and insurance costs.
These conditions shall form the basis of the contract between us and the customer in relation to the sale of goods, to the exclusion of all other terms and conditions including the customer’s standard conditions of purchase or any other conditions which the customer may purport to apply under any purchase order or confirmation of order or any other document.
All orders for goods shall be deemed to be an offer by the customer to purchase goods from us according to these conditions.
Acceptance of delivery of the goods shall be deemed to be conclusive evidence of the customer’s acceptance of these conditions.
These conditions may not be varied except by our written agreement.
These conditions represent the whole of the agreement between us and the customer. They supersede any other conditions previously issued.
All goods will be supplied at the standard prices stated in the Adavale Arts & Crafts price list at the time of order.
Payment can be made in the following ways:
• Payment in cash, or by credit or debit card, in person.
• Alternatively, we can email a payment link which enables customers to pay directly via SumUp. Goods will be dispatched on the next available working day after the payment has been received into our bank account (usually up to 4 working days). A Royal Mail tracked service will be used to send the order and a tracking number will be emailed to the customer on the day of dispatch.
There is no minimum order size.
If you have purchased items from us and they develop a fault, please contact us within 30 days and we will arrange a full refund on receipt of the faulty item. If the item was purchased more than 30 days ago, but less than 6 months ago, we reserve the right to repair the item or provide a replacement.
If you have purchased goods online and wish to return an item, please notify us within 14 days of receipt and return the item to us, undamaged and in its original packaging within 28 days of receipt. We recommend using a Tracked Royal Mail service to ensure you have proof of your return. On receipt of your returned item we will refund the cost of your purchase within 14 days, however we cannot refund your postage or any packaging costs.
If you ordered online and your item has been damaged in transit, please notify us of the damage and supply a photograph of the damaged item within 48 hours of receipt of goods. Please use a tracked Royal Mail service to return the item (in its original packaging if possible) within 28 days of receipt. Once we have received the damaged item we will refund the price of the item and the postage within 14 days.
There is no delivery charge to local customers based in the Isle of Tiree. We can only post to destinations in the UK. Postal charges will be calculated based on delivery destination, weight and size of the goods, and notified to the customer at the time of enquiry and before payment is taken.
Acceptance of the Goods
The customer shall be deemed to have accepted the goods 48 hours after delivery to the customer.
The customer shall carry out a thorough inspection of the goods within 48 hours of delivery and shall give written notification to us within 2 working days of delivery of the goods of any defects which a reasonable examination would have revealed.
Where the customer has accepted, or has been deemed to have accepted, the goods the customer shall not be entitled to reject goods which are not in accordance with the contract.
Retention of Title
Upon delivery of the goods the risk shall pass from us to the customer.
We retain copyright of our work, which allows us to make copies of any item we offer for sale in a variety of formats and for any purpose.
We reserve the right to cancel or delay an order without it being liable for any loss or damage if supply of the goods is prevented or delayed by reason of war, civil strife, riots, adverse weather conditions, fire, flood, labour disputes, accidents or any other circumstances beyond its control.
Any dispute to be governed by Scottish Law.
